I understand that axe throwing is a recreational sport that involves the use of a sharpened steel-headed instrument and that participation carries inherent and unavoidable risks. By signing this waiver I am giving up substantial legal rights, including the right to sue. Read carefully.
I voluntarily assume all risk of injury, property damage, or death arising from my participation in axe throwing at Fling ATL, whether caused by my own actions, the actions of others (including other participants and staff), or the condition of the equipment or premises. I understand that injury can be serious — including but not limited to cuts, lacerations, fractures, eye injuries, and in rare cases more severe outcomes — and I accept that risk knowingly and freely.
I release, waive, discharge, and covenant not to sue Swing ATL · Fling ATL, its owners, employees, contractors, coaches, and agents (the "Released Parties") for any and all liability, claims, demands, actions, or causes of action arising from injury, death, or property damage related to my participation in axe throwing, even when caused by the ordinary negligence of the Released Parties. This release does NOT apply to gross negligence, intentional misconduct, or any liability that cannot be released under Georgia law.
I agree to defend, indemnify, and hold harmless the Released Parties from and against any third-party claims, costs, or damages (including reasonable attorney's fees) arising from my acts or omissions during my participation.
I have read and agree to follow the Fling ATL safety rules: I will throw only from the marked line, only when the lane is clear and the coach has cleared me to throw, only from my assigned side of the lane divider; I will carry axes by the handle, head-down, never overhead or toward another person; I will retrieve axes only when the coach signals it is safe; I will follow all coach instructions; and I will leave the lane when asked.
I understand and agree that closed-toe shoes are required at all times in the axe throwing lanes and retrieval area. I will not enter the lane area in sandals, flip-flops, or other open-toe footwear.
I will not throw axes while under the influence of alcohol, illegal drugs, or any other substance that would impair my judgment, balance, or motor control. I understand that staff may end my session without refund if they determine I am impaired.
I am at least 18 years of age. OR if I am the parent or legal guardian signing on behalf of a minor (10–17 years old), I confirm that I am legally authorized to sign on the minor's behalf, I have explained the risks to them in language they understand, and I will remain on-site for the duration of their session. Participants under 10 years of age are not permitted to throw.
I grant Swing ATL · Fling ATL permission to use my likeness in photographs and video footage captured at the venue for the purpose of marketing the venue. I understand I may revoke this permission for future use at any time by contacting [email protected].
